ABOUT THE SHOW

Kanta Pilipinas is TV5’s biggest musical reality search that will scour the country to search the next star that will make the nation sing!

In a wider-than-ever nationwide audition, TV5 will conduct on-ground auditions on seven key cities in Luzon, Visayas and Mindanao.

The show will chronicle the different stories of many Filipinos aspiring to have their talent be heard. Following their journey, their struggles and their triumphs, we will get to witness their transformation from being regular folks with raw talent to becoming a star.

In Kanta Pilipinas, the contestants will be given a unique opportunity to work with the country’s top music producers to hone their talent, collaborate, produce original compositions and develop their skills and personality – to make the nation sing!

Kanta Pilipinas is scheduled to premiere on July 2012.

Filled with inspiring stories, raw reality, gripping conflicts, intense competition and uplifting music all around – Kanta Pilipinas aspires to set a new standard on entertainment TV and at the same time find new breeds of Filipino artists that will make the nation sing!

WAIVER AND RELEASE

I certify the following:


A. Eligibility and Participation


I. I have voluntarily participated in the Audition [to be considered as a potential contestant in the television program currently entitled “Kanta Pilipinas�? (the “Program�?)] conducted by TV5 through Futuretainment Inc., without any compensation and I assume all risks arising from or associated with my participation in the Audition. As such, I have done or will be doing one or more of the following:

a) Engage in one or more live performances in connection with the Audition, during which my likeness or voice may be recorded in photograph, video or sound and I hereby give my full consent to such recording;

b) Grant one or more interviews to TV5;

c) Provide TV5 through Futuretainment Inc. a full and true account and disclosure of all facts regarding my physical and mental condition, education and life history;

d) Undergo physical, emotional, psychological and other tests and examinations by professionals selected by TV5 through Futuretainment Inc. as required part of the Audition; and

e) Such similar activities as may be connected to the above.



II. The procedure, rules and other material terms for participating in the Audition have been fully made known to me by the Program and/or TV5 through Futuretainment Inc. (the “Terms�?). I accept and agree to be bound by the Terms.

III. I acknowledge that my participation in the Audition and/or the Program is not a professional performance and does not entitle me to any wages, salary, talent fee or other compensation.

IV. If so required, I will supply TV5 through Futuretainment Inc. a copy of my birth certificate or passport confirming my age, or any other document that TV5 and/or Futuretainment Inc. may require in connection with my application.



B. Warranties

1. I hereby warrant that I have the full power and authority to enter into and participate in the Audition; that I am a citizen of the Philippines, or, if not, of Filipino lineage; that I am qualified to join the Audition in accordance with the Terms.

2. I warrant that I have no existing recording agreement with any person, firm or corporation. I understand and accept that if I have an existing recording agreement with any person or entity, I am not eligible and cannot participate in the Program. If in any case I do have an existing recording or any contract with any firm, I warrant that I shall not make TV5 and/or Futuretainment Inc. liable in any way.

3. I warrant that I have no television, movie, endorsement or other agreement with any other person, firm or corporation, and I shall not enter into any such agreements, which will in any way interfere with my participation in the Audition, or with any of the rights of TV5.  4.	In the event that I am represented by a talent manager at the time of my signing of this Waiver and Release (“Manager�?), which I have disclosed to TV5 through Futuretainment Inc., my Manager shall likewise be required to sign this Waiver and Release. I and my Manager (if I have a Manager) hereby agree that TV5 through Futuretainment Inc. shall have the exclusive option to enter into a management agreement with me, and if I have a Manager, upon such election by ___________________, TV5, Manager and ___________________ TV5 and/or TV5’s designated person/entity shall co-manage my professional career. The term of the management sole option may be extended for such longer period as may be determined by TV5 through Futuretainment Inc.   5. Participants in Kanta Pilipinas auditions are prohibited from joining any other talent shows except or unless any information supplied becomes incorrect due to change in circumstances, etc. (i.e. failure to qualify)  Participants chosen after the audition proper shall be prohibited from joining other talent shows for a period of One (1) Year from the date he is chosen/qualified as contestant(non-compete clause).  6.	I warrant that I am in good health, and that I have no disability, injury or any physical, medical or mental condition or any other deficiency that will impair my participation in the Audition. In case of any accident, voluntary or involuntary, during or immediately after my performance at the audition, show proper or Grand Finals, I hereby hold TV5 and Futuretainment free and harmless from any and all actions, civil, criminal, administrative or otherwise, or from any and all claims of any kind or character including but not limited to claims for damages, interests, expenses, or other sums of money or other obligations arising out of my participation in any and all auditions, shows, and grand finals appearance.   7.	I warrant that I am not connected with TV5 and/or Futuretainment Inc., nor related by blood or by consanguinity until the 4th degree to any of the aforesaid entity’s talents, production staff, production crew, employees, officers, directors, agents or consultants. 


C. Non-Disclosure  

1. I acknowledge that I may be given access to or become acquainted with confidential information and trade secrets of TV5 through Futuretainment Inc I shall not disclose directly or indirectly to any third party any such confidential information and trade secrets of TV5  including the terms of this Waiver and Release and the terms and conditions of any contract that I may execute with TV5 . This obligation shall survive my participation in the Audition, and will continue even if I am not selected as a contestant in the Program.

2. I acknowledge that prior to the broadcast of the Program, the plans of TV5  for the Program, and any of the activities, results and developments in the Audition (“Program Content�?), are strictly confidential. I shall not disclose directly or indirectly, to any third party any of the Program Content, unless, such Program Content becomes or is made known to the public by the broadcast thereof by TV5.

3. I shall not make public any complaint or grievance about the Audition, or the Program, including any decision made by TV5 through Futuretainment Inc., and will take this up directly with TV5 through Futuretainment Inc. or their proper officers.


D. Release and Acceptance

1. In the event that I receive from TV5 through Futuretainment Inc. any prize in excess of Ten Thousand Pesos (P10,000.00) (the “Prize�?), TV5 through Futuretainment Inc. shall withhold from the Prize the amount equivalent to twenty percent (20%) of the value of the Prize, which shall be remitted by TV5 through Futuretainment Inc.  to the appropriate government agency as taxes due on the Prize.

2. I am fully aware that the Program and TV5 through Futuretainment Inc. have not authorized any person to promise any employment, contract, benefit or any reward, and that if I decide to make any deal, arrangement of transaction with such unauthorized persons,. I shall hold TV5, Futuretainment Inc., and their respective stockholders, officers, directors, employees, agents, representatives, successors and assigns, licensees and related entities absolutely free and harmless from any claim arising from my decision.

3. I grant permission to the Program and to TV5 to use my name, likeness, identity and appearance or participation in the Audition in any photographs, motion pictures, or any other record, in any and all manner and media in perpetuity, throughout the world. I agree that such record of my participation in the Audition shall become the sole property of TV5 including all copyright and proprietary rights therein, and I hereby irrevocably waive any and all moral rights or similar rights that I may have thereto. The foregoing notwithstanding, I acknowledge that TV5 though Futuretainment Inc. is not under any obligation to record my participation in the Audition or include me in the broadcast version of the Program

4. I hereby absolutely and irrevocably release, and forever hold TV5 and Futuretainment Inc. and any sponsor of the Program, and their respective stockholders, officers, directors, employees, agents, representatives, successors, and assigns, licensees and related parties free and harmless from and against any and all claims and damages I may have for invasion of privacy, defamation, or any other cause of action arising out of or relating to the Audition, the duplication, distribution, broadcast or exhibition of my participation in the Audition, and/or any consent given or undertaking made in this document.


E. Other Conditions

1. I have truthfully and and accurately completed the Official Application Form, that I have not withheld any information requested of me and that by signing this Form and supplying the answers and information requested of me by TV5 through Futuretainment Inc., I have in no way been misleading or untruthful. Should I make any misrepresentation of any matter to TV5 through and/or Futuretainment Inc. or violate the Terms and/or any of my undertakings, warranties or obligations in this Waiver and Release,. I shall be automatically disqualified from the Audition and from any possible inclusion in the Program, without prejudice to any other right or remedy TV5 and/or Futuretainment Inc. may have against me at law or in equity.

2. I accept sole responsibility for all the hazards and risk to my person and my property associated with or related to the Audition or my participation therein, however minimal or minor, as well as for any damage or injury that I may cause to myself or to others, or that may be caused to me by others in the course of my participation in the Audition.

3. My failure to sign (or the failure of a parent to sign in case I am below 18 years of age, and my Manager’s failure to sign in case I am represented by a Manager), this Waiver and Release, or to comply with the foregoing conditions, shall be sufficient ground for my disqualification from the Audition and the Program, and for TV5 and/or Futuretainment Inc.  to take proper legal action against me, such as but not limited to, a claim for damages. The absence of any information on, and the signature of, amy parent/legal guardian (in case I am below 18 years of age) , or the Manager (in case I am represented by a Manager), on this Waiver and Release, shall be sufficient ground to consider the participant as not being represented by a manager at the time of the Audition.
